For the last several years, Stephen A. Harry’s Oklahoma bankruptcy law firm has been helping clients navigate confusing bankruptcy processes, understand their options under federal bankruptcy laws and make a new start without the constant stress of financial difficulty.  “Client education is a priority, and I take the time to explain the differences between Chapter 7 bankruptcy and Chapter 13 bankruptcy so that each of my clients can make an informed decision about their finances and their future.” –Stephen A. Harry.

The process of filing bankruptcy petitions can seem confusing and contradictory, but Attorney Harry alleviates that and allays his clients’ concerns by giving them the individual attention they deserve.  He knows that when they arrive in his office, there is plenty of stress in their lives already. Attorney Harry says “I take a low-stress approach to explaining the law, and my clients appreciate working with one bankruptcy attorney from the first consultation to the successful completion of the bankruptcy process.”

Understanding Chapter 7 Bankruptcy and Chapter 13 Bankruptcy

Bankruptcies are handled exclusively by federal courts, and in Oklahoma, these courts are in Oklahoma City, Tulsa and Okmulgee. The two primary reasons people seek bankruptcy protection are the following:

  • For an honest debtor to receive a fresh start by removing most debts
  • For a debtor to repay creditors in a planned, orderly manner if he or she is able

Under normal circumstances, a person, couple, partnership, corporation or other legal entity begins the process by filing a bankruptcy petition with one of the bankruptcy courts through their bankruptcy attorney.  As part of the filing, they are required to list all creditors and the amount owed to each.  Filing the petition creates a “stay”, which means creditors must cease all debt collection actions against the debtor and his or her property.  The stay is very helpful to clients because as long as it is in effect, creditors may not make harassing phone calls, bring or continue lawsuits against them or garnish wages.
